Why Pennsylvania is different

  • Community HealthChoices (CHC) is the delivery system. Three CHC managed-care organizations operate statewide, covering people who need nursing-facility level of care whether they're in a facility or a home/community waiver setting.
  • Two income paths, not one hard cap. The Department of Human Services (DHS) describes both a $2,982/month individual limit tied to 300% of the SSI federal benefit rate, and a separate medically needy spend-down option — so Pennsylvania isn't a strict income-cap state for every applicant.
  • Filial responsibility is still enforceable. Under 23 Pa.C.S. § 4603, a financially able spouse, child, or parent can be required to help support an indigent family member — a rule the Superior Court applied in *Health Care & Retirement Corp. of America v. Pittas*.
  • No TOD deed, no Lady Bird deed. Pennsylvania has neither tool for real estate; the alternatives are a retained life estate deed or a revocable trust.
  • OPTIONS is a separate, non-Medicaid program. It serves qualifying Pennsylvanians age 60 and older with no income-eligibility requirement, though it can involve a sliding-scale co-payment.
