Florida handles long-term care Medicaid in a way that catches a lot of families off guard. Rather than the spend-down approach used in most states, Florida applies a firm income ceiling, adds a home-equity cap that many guides skip entirely, ranks home-care applicants by frailty instead of by wait time, and is one of a small handful of states that lets homeowners use a Lady Bird deed. Why Florida is different
- An income cap, not a spend-down. Florida caps gross monthly income at $2,982 (2026) for long-term care Medicaid; going over that line generally means setting up a Qualified Income Trust, since there's no way to simply spend down excess income the way many other states permit.
- A home-equity ceiling on top of the homestead exemption. Florida still excludes the primary home as a countable asset, but equity beyond $752,000 (2026) can disqualify an applicant for institutional or waiver care unless a spouse or dependent child lives there.
- Home care isn't first-come, first-served. The state's SMMC waiver ranks applicants for its pre-enrollment list by a frailty score rather than by how long they've been waiting.
- A widely usable non-probate deed. Florida is one of only five states where the Lady Bird (enhanced life estate) deed is routinely used to pass a home to heirs outside of probate.
- Estate recovery stops at the probate line. Because Florida ties Medicaid estate recovery to the probate estate and the state constitution shields homestead property from creditors, a home transferred outside probate is generally untouched by a recovery claim.
