Under OHCA's Medicaid recovery rule, payments made under Title XIX for a member age 55 or older can be recovered, and the rule specifically lists nursing-facility care, HCBS, related hospital care, prescription drugs, physician services, and transportation among the services covered. When the recipient was an inpatient in a nursing facility, an ICF/IID, or another medical institution, the payment becomes a legally recoverable debt — collectible either through a lien on real property, a claim against the estate, or both.
Oklahoma defines "estate" for these purposes as real property, personal property, and other assets included in the member's estate under Title 58 of the Oklahoma Statutes — language that points toward the traditional probate estate rather than an expanded definition sweeping in every jointly held, life-estate, or trust asset. That said, the absence of an expanded-estate label doesn't mean a piece of property is free of some other valid lien or claim, so a title-specific review still matters before anyone assumes an asset is beyond reach.
