Long-Term Care Funding in Arizona
Arizona's long-term-care Medicaid program is ALTCS — the Arizona Long Term Care System — and it works differently from most states because it's an income-cap program administered by AHCCCS. Someone whose income sits above the cap can potentially still qualify by routing income through an Income-Only Trust, often called a Miller trust, but the trust has real drafting and funding requirements that go well beyond opening a bank account.
Arizona also lets homeowners record a statutory beneficiary deed, and it calculates transfer penalties using the private-pay rate for the applicant's specific county rather than one number for the whole state. Both features mean Arizona planning tends to be more local and more income-focused than in states that rely purely on a net-income test or a single statewide divisor.
Why Arizona is different
- Income-cap state. Arizona uses a hard 300%-of-FBR gross-income test for ALTCS; going over it doesn't disqualify someone outright, but it does require an Income-Only (Miller) Trust.
- County-based transfer divisor. Rather than one statewide number, Arizona calculates the length of a transfer penalty using the applicable geographic private-pay rate for the person's county.
- Beneficiary deed, not a recovery shield. Arizona's beneficiary deed under A.R.S. § 33-405 avoids probate but doesn't by itself defeat AHCCCS's probate or small-estate recovery claims.
- ALTCS isn't nursing-home-only. Many ALTCS members live at home or in assisted living while receiving covered services — a nursing-home stay isn't a prerequisite for the program.
- Active Partnership program since 2008. A qualifying Partnership policy protects resources and estate value equal to what the policy has actually paid in benefits.
