Wisconsin Medicaid Estate Recovery

Wisconsin's Estate Recovery Program seeks repayment for specified long-term-care services paid through Medicaid, BadgerCare Plus, the Community Options Program, and non-Medicaid Family Care, as well as services covered by the Wisconsin Chronic Disease Program. According to the Department of Health Services, recovery can reach the member's estate, a surviving spouse's estate, certain non-probate property, and liens filed against a home — a noticeably wider net than a probate-only recovery state.

There's an important carve-out for people who aren't receiving long-term care. The handbook specifically says someone 55 or older living in the community who isn't receiving long-term-care-related services is unaffected by recovery, while nursing-home, home-care, and community long-term-care benefits are the services actually captured by the recovery framework.
