Oregon's 2026 policy transmittal (OEP-PT-26-021) sets a 60-month asset-transfer look-back for both nursing-facility care and home- and community-based services. The update removed older provisions that had reached beyond that window and applies the disqualification framework to specified long-term-care services regardless of whether the underlying Medicaid category is MAGI or OSIPM.

A five-year review doesn't automatically produce the same outcome for every transfer. Oregon first determines whether a given asset transfer is disqualifying under its rules (OAR 461-140-0296), calculates the uncompensated value involved, and only then applies a period during which department-paid nursing-facility or home- and community-based care becomes unavailable.

As of this writing, Oregon's transfer penalty divisor is $14,585 a month, a figure the state has confirmed runs through September 2026.
