Why New Jersey is different

  • Managed care runs long-term services, not fee-for-service. New Jersey's Managed Long Term Services and Supports (MLTSS) program routes nursing-facility, assisted-living, community-residential, and in-home care all through NJ FamilyCare managed-care organizations, rather than a separate conventional nursing-home program.
  • A Qualified Income Trust option since 2014. New Jersey has permitted QITs since December 2014 for applicants above the income cap; income placed correctly into a QIT above 300% of the Federal Benefit Rate doesn't count against Medicaid eligibility, as long as the trust holds only the individual's own income and meets the state's other conditions.
  • The home isn't automatically safe from recovery. New Jersey's recovery materials define the estate to include any property or asset the person had legal title to or an interest in at death — including a home or share of a home, jointly held bank accounts, trusts, annuities, stocks, and bonds — so avoiding probate is not by itself a demonstrated shield.
  • A still-modest personal-needs allowance. New Jersey's nursing-home personal-needs allowance sits at $50 a month.
  • A transfer-on-death deed that isn't law yet. A 2026 bill (S3679) would create a Uniform Real Property Transfer on Death Act in New Jersey, but as of the most recent committee material located, it remained legislative material rather than an enacted statute — so a home transfer today needs title-specific legal advice, not an assumption that a statutory deed tool is already available.
