Kentucky's transfer regulation (907 KAR 20:030) imposes a period of ineligibility for nursing-facility, ICF/IID, and 1915(c) home- and community-based services when assets were given away for less than fair market value during the 60 months right before the applicant's baseline date — for any transfer made on or after February 8, 2006.

CHFS's current manual states the operational version of that rule directly: the look-back period runs 60 months back from the date a person was both institutionalized and applied for Medicaid. It isn't limited to transactions labeled as gifts — a sale or any other disposition made below fair market value can trigger the same review.

Kentucky updates its transfer-resource divider annually; the figure effective January 1, 2026 is $325.41 per day, and the manual directs the agency to apply the divider in effect for the year the transfer becomes known to the agency, not necessarily the year the transfer actually happened.
