Georgia didn't have a general transfer-on-death deed for real estate until relatively recently. Senate Bill 420 created one, effective July 1, 2024, establishing a new chapter of Georgia law — O.C.G.A. Title 44, Chapter 17 — devoted entirely to this deed type (Georgia General Assembly, SB 420; Georgia Code §44-17-2).
There's since been a further legislative wrinkle: House Bill 413, enacted as Act 379, reportedly amended the statute with an effective date of April 22, 2026. That said, this research wasn't able to independently verify the amended statutory text, so anyone relying on the deed today should confirm the current requirements directly with the Georgia General Assembly rather than assuming the original 2024 language still controls every detail.
