Which section applies depends heavily on the specific service someone needs, so it's not a single unified program but a set of related ones.

Functional eligibility for any of these routes runs through the same Maine Assessing Services Agency used for facility admissions — its LTC Advisory assessment can determine eligibility for MaineCare-funded in-home services just as it does for a nursing-facility stay.

The primary older-adult waiver is Section 19, formally the Home and Community Benefits for the Elderly and Adults with Disabilities waiver, identified by DHHS as waiver ME.0276 in its 2026 waiver-amendment notice. That notice describes proposed amendments touching the 2024 revised 1915(c) application, worker requirements, service caps, grievance procedures, funding contingencies, and related cost estimates.
