# Long-Term Care Funding in Wisconsin

Wisconsin pairs a medically needy long-term-care pathway with one of the more generous community-spouse asset protections in the country — a $50,000 minimum asset share for the at-home spouse. But that generosity on the front end comes with a catch on the back end: Wisconsin's estate recovery program reaches well beyond the probate estate into certain non-probate property.

That combination makes home-title planning unusually layered here. Wisconsin does authorize a statutory transfer-on-death deed for real property, but probate avoidance and Medicaid recovery exposure have to be evaluated as two separate questions, not one.

## Why Wisconsin is different

- **A $50,000 minimum community-spouse asset share** — well above the federal floor, Wisconsin's 2026 table protects at least $50,000 for a couple with $100,000 or less in countable assets, scaling up to a $162,660 maximum.
- **Estate recovery reaches non-probate property** — Wisconsin's Estate Recovery Program can pursue property held in joint tenancy, life estates, revocable trusts, and property payable or transferable on death, using affidavits and liens alongside probate claims.
- **A Group B Plus pathway softens the income cliff** — people above the $2,982 institutional categorically needy amount may still qualify for community waivers under Group B Plus, and a separate Medicaid deductible pathway also exists.
- **A recently amended TOD statute** — Wis. Stat. § 705.15 governs Wisconsin's real-property transfer-on-death designation, and 2025 Wisconsin Act 60 (signed December 9, 2025) updated its revocation provisions.
- **VA Aid and Attendance is broadly disregarded** — Wisconsin's Medicaid handbook excludes Aid and Attendance and Housebound allowances from eligibility calculations and from patient-liability and cost-share figures, with one exception for certain State Veterans Home residents without dependents.
