# Long-Term Care Funding in West Virginia

West Virginia takes a spend-down approach to long-term-care Medicaid rather than treating a Qualified Income Trust as the go-to published solution the way income-cap states do. People whose income runs above the applicable maximum can still become eligible when their care costs exceed the Medically Needy Income Limit and the rest of the program's requirements are met — a meaningfully different planning framework than a hard income ceiling.

The state does offer a statutory transfer-on-death deed under its version of the Uniform Real Property Transfer on Death Act, which lets a homeowner name a beneficiary who receives the property automatically at death, outside of probate. But that deed only transfers ownership at death — it isn't a present-day gift — so it should not be treated as a guaranteed way to keep a home out of Medicaid's recovery reach.

## Why West Virginia is different

- **Spend-down model, not an income cap**: West Virginia's published Medicaid materials describe a spend-down pathway for people above the income maximum rather than pointing to a Qualified Income Trust as the standard fix.
- **Statutory TOD deed available**: the state has enacted the Uniform Real Property Transfer on Death Act, giving residents a revocable, recordable deed that transfers property at death without probate.
- **TOD deed is not a recovery shield**: state elder-law guidance and the estate-recovery manual both caution that Medicaid recovery can still reach TOD-deed property after the transferor's death.
- **Waiver capacity is a real constraint**: the Aged and Disabled Waiver reported roughly 8,750 CMS-approved slots as of March 2026, and a Managed Enrollment List can delay entry into the program.
- **Two review tracks for nursing-home applicants**: financial eligibility runs through the county Department of Human Services office, while medical necessity is assessed separately through PAS-2000 and PASRR review.

## The 10 funding pillars in West Virginia

Every pillar below has its own dedicated West Virginia page with the current rules, dollar figures, and what to do next.

- [West Virginia Medicaid Long-Term Care](https://fundingltcmarketplace.com/states/west-virginia/medicaid-long-term-care/) (Medicaid Program): West Virginia Medicaid covers nursing facilities, ICF/IID care, and home- and community-based pathways, with medical and financial review handled through separate systems.

- [West Virginia Medicaid Asset Limits](https://fundingltcmarketplace.com/states/west-virginia/medicaid-asset-limits/) (Financial Eligibility): West Virginia’s published long-term-care rules combine modest countable-resource limits, a spend-down route, federal spousal protections, and a home-equity threshold.

- [West Virginia Medicaid Look-Back Period](https://fundingltcmarketplace.com/states/west-virginia/medicaid-look-back-period/) (Look-Back & Penalties): West Virginia uses a five-year transfer review for long-term-care Medicaid, making gifts, life-estate transfers, and below-market title changes timing-sensitive.

- [West Virginia Transfer-on-Death Deed](https://fundingltcmarketplace.com/states/west-virginia/transfer-on-death-deed/) (Asset Protection Tool): West Virginia authorizes a revocable, recorded transfer-on-death deed, but death-time transfer and estate-recovery treatment require separate analysis.

- [West Virginia Medicaid Estate Recovery](https://fundingltcmarketplace.com/states/west-virginia/medicaid-estate-recovery/) (Estate Recovery): West Virginia’s recovery policy reaches the recipient’s estate after specified Medicaid-funded long-term-care services and provides survivor and hardship protections.

- [West Virginia Nursing Home Medicaid](https://fundingltcmarketplace.com/states/west-virginia/nursing-home-medicaid/) (Nursing Home Coverage): Nursing-facility Medicaid requires a financial determination plus PAS-2000 medical-necessity and PASRR review, with a $50 resident personal-needs allowance.

- [West Virginia Home Care Medicaid](https://fundingltcmarketplace.com/states/west-virginia/home-care-medicaid/) (Home & Community Care): The Aged and Disabled Waiver supports people who meet nursing-facility level of care at home, but CMS slots and the Managed Enrollment List can delay entry.

- [West Virginia Long-Term Care Planning](https://fundingltcmarketplace.com/states/west-virginia/long-term-care-planning/) (Planning Ahead): West Virginia planning must coordinate a spend-down pathway, five-year transfers, a statutory TOD deed, waiver capacity, and estate recovery rather than rely on a single document.

- [West Virginia VA Aid & Attendance](https://fundingltcmarketplace.com/states/west-virginia/va-aid-attendance/) (VA Benefits): Veterans should coordinate VA Aid and Attendance with West Virginia Medicaid, the VA’s $90 nursing-facility pension rule, operating state facilities, and disabled-veteran tax relief.

- [West Virginia Long-Term Care Insurance](https://fundingltcmarketplace.com/states/west-virginia/long-term-care-insurance/) (LTC Insurance): West Virginia regulates LTC insurance and retains a statutory Partnership framework, but current new-sale availability should be confirmed directly with the Insurance Commissioner.
