# Long-Term Care Funding in Washington

Washington runs long-term-care Medicaid through Apple Health, and the state splits the work between two agencies: the Health Care Authority sets financial-eligibility policy while DSHS's Aging and Long-Term Support Administration carries out the functional side through its CARE assessment. That split matters in practice — a family that clears the financial bar still needs a completed functional review before services actually start, and a functional need on its own never substitutes for financial approval.

The state also gives residents a statutory transfer-on-death deed for real property, which is revocable and must be recorded before the owner dies. It's a useful probate-avoidance tool, but it doesn't insulate a home from Washington's recovery law, which reaches beyond probate into nonprobate assets and can even support a lien against a decedent's life-estate or joint-tenancy interest.

## Why Washington is different

- **Two agencies, two jobs.** HCA handles Apple Health financial-eligibility policy; DSHS's ALTSA division runs the CARE functional assessment that actually determines the services someone receives.
- **Medically needy pathway exists.** Washington doesn't treat the special income level as the only route in — SSI-related applicants who don't qualify as categorically needy may still qualify as medically needy under separate LTC rules.
- **Expanded, not probate-only, recovery.** For services received at 55 or older, Washington's recovery statute reaches nonprobate assets and permits liens against certain life-estate and joint-tenancy interests — well beyond a typical probate-only state.
- **TOD deed doesn't block recovery.** The deed avoids probate and leaves the owner's rights untouched during life, but it does not shield a home from the state's expanded recovery reach.
- **Active LTC Partnership program.** A qualifying Partnership policy protects assets equal to the benefits the policy actually pays, layered on top of Apple Health's standard resource rules.
