# Long-Term Care Funding in Virginia

Virginia gives families more than one road into long-term-care Medicaid eligibility, combining a 300%-of-SSI income group with a medically needy spend-down path — and rather than publishing one flat statewide transfer-penalty divisor, it calculates that penalty using the private-pay nursing-facility cost in the applicant's own locality. Its transfer-on-death deed, meanwhile, is explicit that recording one has no effect on public-assistance eligibility while its maker is alive. The pages in this cluster work through what those Virginia-specific mechanics actually mean pillar by pillar.

Every figure here traces back to Virginia's Department of Medical Assistance Services (DMAS) and its Cover Virginia consumer materials — not a generic, one-size-fits-all state summary.

## Why Virginia is different

- **Two income routes instead of one hard cap.** Virginia's 2026 manual lists a $2,982-a-month, 300%-of-SSI income standard for the institutional/waiver group, but it also runs a medically needy spend-down path — so an applicant over the cap shouldn't automatically assume a Qualified Income Trust is the only option.
- **No single statewide transfer-penalty divisor.** Rather than publishing one number for the whole state, Virginia calculates the transfer penalty using the average monthly private-pay nursing-facility cost specific to the applicant's locality.
- **A transfer-on-death deed that stays inert during life.** Virginia has authorized a statutory TOD deed since 2013; properly recorded, it creates no beneficiary interest and has no effect on the owner's or beneficiary's public-assistance eligibility while the owner is alive.
- **Estate recovery still reaches beyond probate.** At death, Virginia's recovery regulation uses an expanded estate definition covering any property the deceased held legal title to or an interest in, which can include a TOD-deeded home.
- **A comparatively modest $40 personal-needs allowance.** Virginia's facility personal-needs allowance sits at $40 a month, factored into the broader patient-pay calculation.
