# Utah Transfer-on-Death Deed

Last updated 2026-10-20

**Quick answer:** Yes. Utah Code § 75-6-405 allows a transfer-on-death deed that passes real estate to named beneficiaries at the owner's death. It must be recorded before the owner dies, and it can't be used for a class gift.

Utah's statutory tool here is the transfer-on-death deed. Utah Code Section 75-6-405 lets an individual name one or more beneficiaries to receive real property effective at the owner's death, though the statute doesn't allow using this deed to make a class gift. It's strictly a death-time transfer mechanism for real property — not an enhanced life-estate deed with different rules.

The Utah Legislature's Uniform Real Property Transfer on Death Act materials include a statutory form, and they're explicit that the form has to be recorded before the owner's death to take effect. Both the statute (Section 75-6-416) and the form deserve review by the drafting attorney and the county recorder in their current form, since a beneficiary's name, a competing later deed, or an attempted revocation can all change the outcome.
