# Long-Term Care Funding in Utah

Utah takes the medically needy route to long-term-care Medicaid rather than running a conventional income-cap system, which means a Qualified Income Trust is treated as an asset transfer here instead of the routine fix families may expect from a neighboring state's rules.

Utah also authorizes a transfer-on-death deed for real estate, but its estate-recovery statute reaches further than a simple probate claim — recovery can pull from a recovery estate and from certain grantor-beneficiary trusts as well, so a deed alone won't close the planning loop.

## Why Utah is different

- **Medically needy, not income-cap:** Utah covers nursing-facility services through its **medically needy coverage group**, so a Qualified Income Trust functions as a transfer question rather than an automatic Miller Trust fix.
- **Trust-reaching recovery:** Utah's Estate and Trust Recovery statute lets the state recover not just from a probate estate but also from **certain grantor-beneficiary trusts**.
- **High-end home-equity treatment:** Utah's own rule cites $500,000 or the increased federal amount, and CMS's 2026 federal range tops out at **$1,130,000** — worth confirming against the live state notice.
- **Nine HCBS waivers:** Utah runs **nine Section 1915(c) waivers**, including Aging and New Choices pathways, giving home-care applicants more routes to sort through than in many states.
- **Lower nursing-home personal-needs allowance:** Utah's manual states a **$45** monthly personal-needs allowance, notably below the $75 figure common elsewhere.
