# Long-Term Care Funding in South Dakota

South Dakota runs long-term care Medicaid on an income-cap model, which changes the whole planning conversation compared with states that simply require a spend-down. The Department of Social Services sets the 2026 monthly limit at $2,982 — equal to 300% of the SSI standard benefit — and a person earning more than that generally needs an approved income trust rather than just spending assets down to qualify.

Two agencies split the workload here: DSS handles financial eligibility while the Department of Human Services runs nursing-facility level-of-care determinations and the HOPE waiver process for home- and community-based care. Because South Dakota's estate-recovery rules reach further than a routine probate filing, and its transfer-on-death deed statute doesn't spell out Medicaid consequences, families need to treat title and recovery as two separate legal questions rather than assuming one tool solves both.

## Why South Dakota is different

- **Hard income cap, not a simple spend-down** — the $2,982 monthly limit (300% of the SSI benefit) can force use of an approved income trust for applicants over the threshold.
- **Estate recovery reaches beyond probate** — DSS can pursue facility trust accounts, joint bank accounts, CDs, irrevocable income trusts, and life estates, not just assets that pass through a will.
- **A surviving spouse has a narrow window to push back** — state law gives a surviving spouse a six-month petition route to limit the estate's financial exposure to a recovery claim.
- **The transfer-on-death deed is a title tool, not a recovery shield** — the deed is revocable and effective at death, but the statutes reviewed don't clearly resolve how a TOD interest is treated for Medicaid purposes.
- **Only one home-care waiver serves most older adults** — HOPE is the primary at-risk-of-institutionalization waiver alongside three other narrower 1915(c) waivers.
- **The Partnership insurance market is active** — carriers including LifeSecure, Mutual of Omaha, New York Life, and Northwestern Long Term Care Insurance Company currently market individual Partnership policies in the state.
