# Ohio Medicaid Estate Recovery

Last updated 2026-10-20

Ohio's Medicaid estate-recovery program operates under state law, with the Ohio Attorney General's Office pursuing claims on the Department of Medicaid's behalf. Families should know this isn't a probate-only system.

Ohio's statutory definition of the recoverable estate reaches beyond what passes through probate court. It can include real and personal property interests that pass to a survivor, heir, or assign through joint tenancy, tenancy in common, survivorship arrangements, life estates, living trusts, or similar mechanisms — which is why home-transfer planning in Ohio has to account for more than just probate.
