# Long-Term Care Funding in North Carolina

North Carolina leaves families with fewer probate-avoidance tools than most states, and that shapes everything else about long-term-care planning here. The state has no transfer-on-death deed statute for real property and no Lady Bird deed shortcut, while its Medicaid estate-recovery program is expanded well beyond probate — reaching life estates, living trusts, and survivorship property (NCDHHS Policy MA-2285).

That combination means the deed-based strategies that work elsewhere often don't translate directly to North Carolina. Families here typically need to think about Medicaid planning and home protection as two separate, carefully coordinated problems rather than one that a single legal document can solve.

## Why North Carolina is different

- **Estate recovery is expanded, not probate-only.** North Carolina's policy reaches life estates, living trusts, survivorship property, and other nonprobate transfers, so avoiding probate doesn't necessarily avoid a Medicaid claim.
- **No real-estate TOD deed or Lady Bird deed shortcut.** State law has no transfer-on-death provision for real property, and life estates or living trusts remain within reach of expanded recovery.
- **A medically needy deductible route exists.** Qualifying medical expenses can help establish Medicaid eligibility when income exceeds the categorically needy threshold.
- **A newly uniform five-year transfer review.** A September 2025 policy revision standardized the 60-month look-back period across all transfer types, closing an older exception.
