# Long-Term Care Funding in New York

New York does things its own way when it comes to paying for long-term care. Rather than capping income outright, the state lets applicants who earn too much qualify through a spend-down of medical expenses, and it recently added a transfer-on-death deed option in 2024 even though Medicaid Asset Protection Trusts (MAPTs) remain the tool most families and attorneys actually rely on. A community-based Medicaid look-back has been proposed for years but, as of August 2026, still has not taken effect.

The pages in this cluster walk through each of the ten funding pillars as they actually operate in New York, from initial eligibility through estate recovery, so you can see where the state's rules diverge from the national default.

## Why New York is different

- **Spend-down instead of a hard income cap.** Applicants above New York's Non-MAGI income threshold can still qualify by applying medical bills toward the excess, or by using a qualifying pooled income trust — a very different structure from strict income-cap states.
- **Institutional and community timelines don't match.** The five-year (60-month) look-back is fully active for nursing-facility Medicaid, but the long-discussed 30-month look-back for community-based care remained unimplemented as of August 2026.
- **A brand-new deed option, but an old planning favorite.** New York's Real Property Law §424 created a statewide transfer-on-death deed effective July 19, 2024, yet MAPTs are still the more established route for protecting assets ahead of institutional care.
- **Recovery stops at the probate line.** New York directs local districts to exclude non-probate assets from Medicaid estate recovery, a policy that's been in place since a December 6, 2011 reversal of a broader recovery rule.
