# Long-Term Care Funding in Nevada

Nevada runs its long-term-care Medicaid program on an income-cap model, which means a single applicant whose monthly income lands above the state's ceiling can't simply spend down the excess the way many other states allow — a Qualified Income Trust becomes the tool that keeps the case alive.

The state also takes a broad view of what counts as an estate once someone has passed away and received Medicaid-funded care. Recording a deed upon death can steer real property around probate court, but it doesn't automatically settle whether Nevada's recovery unit can still reach that property under the state's 'undivided estate' definition.

## Why Nevada is different

- **Income-cap structure**: Nevada applicants over the monthly cap generally need a Qualified Income Trust (also called a Miller or income-cap trust) rather than a standard spend-down.
- **Three agencies split the work**: the Nevada Health Authority publishes Medicaid manuals, DWSS processes the actual applications, and ADSD runs the home-and-community waiver programs — so a single case can touch all three.
- **Expanded estate-recovery definition**: Nevada's 'undivided estate' under NRS 422.054 reaches property or assets the recipient held an interest in immediately before or at death, not just what passes through probate.
- **Deed upon death is available but not a complete answer**: Nevada's Uniform Real Property Transfer on Death Act lets an owner record a revocable deed effective at death, but that doesn't resolve the separate Medicaid-recovery question.
- **Multiple home-and-community waivers**: the Frail Elderly, Physical Disabilities, and Structured Family Caregiving waivers all offer alternatives to a nursing facility, though each is capped by available funding and enrollment.
