# Long-Term Care Funding in Nebraska

Nebraska doesn't run a strict income-cap system for long-term-care Medicaid the way some states do. Instead, it uses a Medically Needy share-of-cost route: someone whose income lands above the standard threshold can still qualify by directing income above the Medically Needy Income Level toward their medical bills. That structural choice means a Qualified Income Trust isn't the default answer here — the state's own program materials point families toward spend-down instead.

Where Nebraska gets unusually specific is its transfer-on-death deed law. The statute authorizing TOD deeds carries a built-in warning: a named beneficiary can be personally liable, up to the value of the transferred property, for Medicaid reimbursement, and the Department of Health and Human Services may require the deed to be revoked before the transferor or their spouse can qualify for or keep Medicaid. That's a rare degree of explicitness for a probate-avoidance tool, and it should give any homeowner pause before treating a TOD deed as a simple, no-strings way to pass on the house.

## Why Nebraska is different

- **Medically Needy spend-down, not a hard income cap**: Nebraska lets applicants over the income limit qualify by obligating excess income to medical bills each month, rather than requiring a Qualified Income Trust.
- **TOD deed comes with a statutory Medicaid warning**: the law authorizing Nebraska's transfer-on-death deed explicitly states a beneficiary may owe reimbursement, and DHHS can require revocation for Medicaid eligibility.
- **Recovery estate reaches well past probate**: Nebraska's statute names TOD-deed property, joint tenancy interests, retained life estates, living trusts, insurance and annuity beneficiary designations, and retirement accounts as recoverable.
- **MLTC runs both Medicaid and HCBS**: DHHS's Medicaid and Long-Term Care division is the single administrative home for nursing-facility coverage, waivers, and PACE.
- **No expected AD Waiver waitlist**: the current Aged and Disabled Waiver, renewed by CMS from July 1, 2026 through June 30, 2031, is not reporting a waiting list in its current application.
