# Long-Term Care Funding in Montana

Montana handles nursing-home Medicaid eligibility in a way that surprises a lot of families: instead of comparing income to a fixed cap, the state simply asks whether your monthly nursing-home bill is at least as large as your monthly income. Layer on a medically needy spend-down option, and Montana's rules end up feeling less like a strict gate and more like a budgeting exercise.

That flexibility on the income side doesn't carry over to how Montana treats your home. The Department of Public Health and Human Services (DPHHS) explicitly lists property moved through a transfer-on-death (beneficiary) deed as fair game for estate recovery after death, which makes home-title planning here a genuinely state-specific conversation rather than a copy-paste national strategy.

## Why Montana is different

- **No hard income cap for nursing-home Medicaid** — eligibility instead compares your monthly facility cost to your monthly income, with a medically needy spend-down (cash option, incurred medical bills, or both) as a backstop.
- **Transfer-on-death deeds don't shield the house** — Montana authorizes them under its Uniform Real Property Transfer on Death Act, but its own recovery brochure says beneficiary-deed and quitclaim-deed property is still reachable.
- **Recovery reaches beyond probate** — DPHHS pursues joint-tenancy interests, tenancy-in-common shares, and property passing by survivorship, not just what runs through probate court.
- **The Big Sky Waiver has a waitlist** — the state's main home-and-community-based route for nursing-facility-level care isn't guaranteed to start right away.
- **Three State Veterans Homes** operate in Columbia Falls, Butte, and Glendive, giving veterans an in-state institutional option alongside VA Aid & Attendance.
