# Massachusetts Long-Term Care Insurance

Last updated 2026-10-20

Long-term-care insurance in Massachusetts falls under the Division of Insurance's regulation 211 CMR 65.00, which sets standards for individual policies and non-employment-based group policies alike — covering everything from disclosure requirements to marketing practices to agent training.

The Division keeps a published list of individual LTC policies that meet 211 CMR 65.00's standards, but it comes with caveats: the list skips group policies and anything reviewed through the Interstate Insurance Product Regulation Commission, and it's dated June 16, 2023. That makes it a historical approval reference rather than confirmation that a given carrier is actively selling that policy today.

What sets Massachusetts apart from many states is the absence of a federal LTC Partnership Program here. Instead, the state runs its own MassHealth-qualified coverage framework, and a qualifying policy under that framework can carry home and estate-recovery protections that are distinct from — and in some respects more specific than — what a Partnership-style policy would provide elsewhere.

## Does Massachusetts have a Long-Term Care Partnership program?

**No.** Massachusetts doesn't take part in the federal Long-Term Care Partnership program. Instead, MassHealth recognizes certain **MassHealth-qualified** long-term care insurance policies, which can carry their own protections for the home and against estate recovery. Ask the Division of Insurance or the insurer whether a policy is MassHealth-qualified.

A Partnership policy bought in another state doesn't receive Partnership asset protection when you apply for MassHealth. The policy still pays the benefits it promises.
