# Long-Term Care Funding in Massachusetts

Massachusetts runs its Medicaid long-term care program, MassHealth, differently from most of the country. The Executive Office of Health and Human Services administers MassHealth through its Division of Medical Assistance under Massachusetts General Laws Chapter 118E, pairing financial eligibility with a required clinical screening rather than treating a nursing-home placement as an automatic benefit.

The pages in this cluster translate MassHealth's current figures, its life-estate deed pitfalls, its probate-only estate recovery model, and its distinct MassHealth-qualified long-term-care insurance framework into plain language for Massachusetts families — no boilerplate borrowed from another state's rules.

## Why Massachusetts is different

- **Estate recovery reaches only the probate estate.** MassHealth's published policy pursues reimbursement from a deceased member's probate estate rather than every nonprobate form of title, which is narrower than an expanded-recovery state — though a pre-death lien and a transfer penalty still need separate analysis.
- **No confirmed real-property transfer-on-death deed.** Massachusetts has enacted transfer-on-death registration for securities, but the only real-estate beneficiary-deed material found is a 2019–2020 legislative proposal (H.3382) that never became law; a retained life-estate/remainder deed has shown up in MassHealth litigation as a transfer with eligibility consequences.
- **No federal LTC Partnership Program.** Instead, Massachusetts regulates long-term-care insurance through its own Division of Insurance rule (211 CMR 65.00), and a MassHealth-qualified policy can carry home and estate-recovery protections that differ from what a Partnership policy would offer.
- **A high home-equity ceiling.** The 2026 maximum home-equity figure is $1,130,000 — well above the federal floor many states use — which changes the calculus for homeowners weighing a deed transfer against staying in MassHealth-exempt status.
- **A BRAVE Act carve-out for veterans.** Massachusetts has a state-specific rule that can disregard specified VA pension, Aid and Attendance, and housebound payments in the MassHealth financial review, on top of operating two State Veterans Homes.
