# Long-Term Care Funding in Maine

Maine allows a recorded transfer-on-death deed, but its Medicaid estate-recovery definition reaches well beyond the probate estate — sweeping in life estates, living trusts, and other nonprobate interests. That gap between what a TOD deed protects during life and what recovery can reach after death is one of the more important distinctions for Maine families to understand early.

Maine is also a medically needy state that uses a deductible, rather than a Qualified Income Trust, as its published route for people whose income runs over the applicable limit. The ten topic pages below walk through eligibility, transfers, the home, facility and community care, veterans benefits, and insurance regulation as they currently stand under Maine law.

## Why Maine is different

- Maine's Medicaid program is called **MaineCare**, run by the Department of Health and Human Services, with financial eligibility handled by the **Office for Family Independence** and functional assessments handled through the **Office of Aging and Disability Services'** Assessing Services Agency.
- Rather than requiring a Qualified Income Trust for people over the income limit, Maine's consumer materials describe a **deductible** — MaineCare begins paying once the deductible amount has been met for that period.
- Maine enacted a statutory **transfer-on-death deed** under Title 18-C, but the state's estate-recovery statute (Title 22 §14) defines "estate" broadly enough to reach survivorship interests, life estates, living trusts, and joint tenancy in personal property — while specifically excluding joint tenancy in real property.
- The state's key home-care waiver, **Section 19** (Home and Community Benefits for the Elderly and Adults with Disabilities, waiver ME.0276), showed **3,718 participants and a zero waitlist** in the latest quarterly OADS access report, current through March 31, 2026.
- Maine's posted Eligibility Manual carries an effective date of **April 29, 2025**, so figures should be checked against any newer chart update before being relied on for a fresh application.
