# Kentucky Medicaid Estate Recovery

Last updated 2026-10-20

Kentucky's Department for Medicaid Services is required to pursue recovery from a deceased recipient's estate for any period of institutionalization, though the amount recovered can't exceed what Medicaid actually paid on that person's behalf during that period (907 KAR 1:585).

What sets Kentucky apart is how broadly the regulation defines "estate." It covers ordinary probate property, but it also reaches real or personal property in which the recipient held legal title or an interest at death — to the extent of that interest — when it passed through joint tenancy, tenancy-in-common survivorship, a life estate, a living trust, or another similar arrangement.

That expanded definition is the reason title choices in Kentucky carry extra weight. Simply avoiding probate through a life estate, joint title, or a living trust doesn't automatically avoid recovery the way it might in a state with a narrower recovery rule.
