# Long-Term Care Funding in Kentucky

Kentucky runs a hard long-term-care income cap, which means an applicant over the limit can't simply spend down the way they might in a medically-needy state — the fix here is a Qualifying Income Trust, often called a Miller trust, built and funded under the state's specific rules. That single design choice shapes almost every other planning conversation in Kentucky.

Title decisions carry more weight here than in many states. Kentucky's estate-recovery definition reaches beyond the probate estate to interests passing through joint tenancy, life estates, and living trusts, and — as of the 2026 legislative session — the state still has no enacted transfer-on-death deed statute for real property. A bill that would have created one, Senate Bill 34, stalled in a House committee rather than becoming law.

## Why Kentucky is different

- **Hard income cap paired with a Qualifying Income Trust option** — income above the special standard requires an irrevocable QIT (Miller trust) built to Kentucky's specifications, not an informal spend-down.
- **No enacted transfer-on-death deed for real property** — 2026 Senate Bill 34 would have created one but stalled in a House committee; families instead work with traditional life estates.
- **Expanded estate recovery reaches non-probate interests** — Kentucky's recovery rule pulls in property passing by joint tenancy, tenancy-in-common survivorship, life estate, or living trust, not just probate assets.
- **HCB waiver has a live waitlist** — Kentucky's home- and community-based waiver serves older adults and people with physical disabilities, but placements are processed by application receipt date against a waitlist.
- **Four State Veterans Centers plus a VA-specific Medicaid rule** — veterans coordinate Aid and Attendance with Kentucky's special income treatment and its $90 nursing-facility VA pension rule.
