# Long-Term Care Funding in Iowa

Iowa runs its long-term-care Medicaid program as an income-cap state, which means an applicant whose monthly income exceeds the state's ceiling generally needs a Medical Assistance Income Trust — not an ordinary spend-down — to become eligible. On the recovery side, Iowa casts a wide net: its estate-recovery policy reaches joint property interests, trust interests, and retained life estates, not just what passes through a conventional probate estate.

One thing Iowa families should know before assuming a common planning tool is available: the state doesn't currently have an enacted transfer-on-death deed for real property. A bill proposing one has been introduced in the legislature, but as of now it remains just that — introduced, not law.

## Why Iowa is different

- **Income-cap structure**: Iowa's 2026 limit is $2,982 per month (300% of the SSI benefit rate), and applicants above that figure typically need a Medical Assistance Income Trust, also called a Miller Trust, which comes with a state-payback requirement at death.
- **No enacted real-property transfer-on-death deed**: current Iowa Code chapter 633D only covers transfer-on-death registration for securities. House File 816 would create a real-property TOD deed act, but it remains labeled **introduced**, not enacted law.
- **Expanded estate-recovery definition**: Iowa's recovery policy explicitly reaches jointly held property, trust interests, and retained life estates — a broader net than an ordinary probate-only estate.
- **Elderly Waiver stays separate**: even as Iowa consolidates six diagnosis-based waivers into new combined programs, it deliberately kept the Elderly Waiver on its own track after hearing concerns about access for people 65 and older.
- **Dual income-cap guardrails for trusts**: beyond the basic income limit, Iowa's Medical Assistance Income Trust guidance adds a second ceiling — gross monthly income can't exceed 125% of the statewide average facility charge.
