# Long-Term Care Funding in Illinois

Illinois recognizes the Transfer on Death Instrument (TODI) for passing real estate outside of probate, which puts it ahead of some states on that front. But Illinois also has an unusual problem: its own state agencies publish conflicting 2026 figures for Medicaid asset limits and spousal resource allowances, and those numbers haven't been reconciled.

This cluster walks through each of the ten national funding pillars as they operate under Illinois's specific programs, agencies, and — where it matters — its unresolved figure conflicts, so nothing gets flattened into a generic answer that doesn't hold up in practice.

## Why Illinois is different

- **A real, published asset-limit conflict.** The Department of Healthcare and Family Services (HFS) lists $2,000 for a single applicant and $3,000 for a couple, while the Department on Aging's 2026 materials list $17,500 for AABD/long-term-care eligibility — a genuine state-source conflict, not just a rounding difference.
- **Spend-down, not one hard income cap.** Illinois uses a medically needy excess-income model; commonly quoted 2026 income figures come from secondary sources and need direct confirmation.
- **A facility-specific transfer penalty.** The Illinois Department of Human Services (IDHS) calculates a transfer penalty from the private-pay cost of the specific nursing facility involved, rather than one fixed statewide divisor, and there's no stated maximum penalty length.
- **TODI plus probate-only recovery.** Illinois's Transfer on Death Instrument can move real property outside probate, but formalities and creditor claims still apply — and HFS estate recovery itself stays probate-only, with a $25,000 first-dollar exemption for qualifying deaths.
