# Long-Term Care Funding in Idaho

Idaho stands apart from many states because it caps applicant income for nursing-home and waiver Medicaid rather than relying on a spend-down formula. When a family's monthly income runs above that ceiling, an irrevocable Qualified Income Trust — often nicknamed a Miller Trust — becomes the tool that keeps an application moving, and Idaho itself must be named the trust's remainder beneficiary. That single feature changes how every other piece of the plan gets built.

The state also takes an unusually wide view of what counts as part of an estate once Medicaid has paid for care. Idaho's recovery statute doesn't stop at property that passes through probate; it reaches joint tenancy interests, survivorship arrangements, life estates, and living trusts. Add to that the absence of a general transfer-on-death deed for real property, and home-title decisions in Idaho carry more weight than they would in states with a simpler beneficiary-deed option.

## Why Idaho is different

- **Income cap, not spend-down**: nursing-home and waiver applicants face a hard monthly income ceiling, with a Qualified Income Trust as the standard workaround for people over the limit.
- **No general TOD deed for real estate**: Idaho has not enacted a transfer-on-death deed statute covering ordinary real property, so title planning depends on other tools like joint tenancy or living trusts.
- **Expanded estate-recovery reach**: recovery isn't limited to probate assets — jointly held property, survivorship interests, life estates, and living-trust assets can all be pulled into the recovery estate.
- **Two-step eligibility process**: DHW determines financial eligibility first, then requires a separate Level of Care Determination before nursing-home or HCBS services are approved.
- **Active Partnership program**: Idaho's Long-Term Care Partnership Program has been running since November 2006 and currently lists certified carriers and forms, so it isn't a closed legacy benefit.
