# Idaho Home Transfer Planning

**Quick answer:** Idaho has no general transfer-on-death deed for real estate and no Lady Bird (enhanced life estate) deed. Idaho's transfer-on-death law covers securities only.

One thing Idaho notably lacks is a general transfer-on-death deed statute for real estate. No research turned up an Idaho law authorizing a standard TOD deed, and there's likewise no enhanced life-estate deed — sometimes called a "Lady Bird" deed — on the books. What Idaho does have is a Uniform TOD Security Registration Act, but that only covers securities registered in beneficiary form; it says nothing about transferring land at death.

Idaho's broader nonprobate-transfer statute, Idaho Code § 15-6-201, does recognize certain contractual or trust arrangements that pass property at death, and it makes clear that creditor rights aren't cut off by using them. It also allows a written, deed-form agreement to pass real property at death to a surviving spouse — but that's a narrow spousal provision, not a general-purpose beneficiary deed available to any unrelated person a family might want to name.
