# Long-Term Care Funding in Georgia

Georgia is in an unusual spot right now: lawmakers just gave homeowners a brand-new transfer-on-death deed, yet the state's Medicaid recovery program already reaches well past a plain probate estate, into joint tenancy and life-estate interests. Nobody has fully settled how those two rules interact, which makes Georgia one of the trickier states to plan in without state-specific guidance. The ten pages in this cluster translate Georgia's actual program rules, agency by agency, into what they mean for a real family.

Every number and citation below comes from Georgia's Department of Community Health, its Division of Family and Children Services policy manual, and the state's own General Assembly records — not generic 50-state summaries.

## Why Georgia is different

- **Fee-for-service, not mandatory managed care, for long-term services.** Georgia Families is the state's mainstream Medicaid managed-care program, but aged, blind, and disabled applicants who need long-term services and supports are carved out and served through fee-for-service Medicaid and four separate HCBS waivers instead.
- **A hard income cap paired with a Georgia-specific trust process.** Anyone at or above the $2,982-a-month cap can't simply spend down; Georgia requires a properly structured Qualified Income Trust to get under the line.
- **A brand-new deed sitting next to an expanded recovery net.** Georgia's transfer-on-death deed statute only took effect July 1, 2024, but the state's recovery policy already reaches joint-tenancy and life-estate interests — so a TOD deed is not yet a demonstrated shield against recovery, and that gap needs a lawyer's eyes, not an assumption.
- **A $70 personal-needs allowance.** Georgia's current DFCS table sets nursing-home personal spending money at $70 a month, despite an inconsistent $75 figure floating around on some secondary consumer sites.
- **Aid & Attendance gets favorable treatment.** Georgia excludes VA Aid & Attendance payments from both Medicaid income eligibility and the patient-liability calculation, which is more generous than how some other states handle it.
