# Long-Term Care Funding in District of Columbia

Washington runs its Medicaid long-term-care program a little differently than most states you'll read about. Instead of pushing every applicant whose income sits above the limit into a Qualified Income Trust, the District's Department of Health Care Finance (DHCF) offers two separate doors: a Special Income Standard set at 300% of the SSI federal benefit rate — $2,982 a month in 2026 — and, for people above that line with substantial medical bills, a medically needy spend-down track. Knowing which door applies before you start paperwork can save months.

The District also stands out on the legal-planning side. It has adopted the Uniform Real Property Transfer on Death Act, giving homeowners a revocable, recordable deed that passes real estate outside of probate. But because DHCF defines an estate for Medicaid recovery purposes as property that doesn't pass to someone else at death, that deed interacts directly with what the District can and can't claim back later — so title work and Medicaid strategy really need to be reviewed side by side, not separately.

## Why District of Columbia is different

- **Two income paths, not one:** a 300%-of-SSI Special Income Standard sits alongside a medically needy spend-down option, so a higher income doesn't automatically mean a trust is required.
- **A statutory transfer-on-death deed exists**, but it doesn't override Medicaid's estate-recovery definition — the two rules have to be read together.
- **Estate recovery is probate-focused**: DHCF and the District's Medicaid state plan define the recoverable estate around property that doesn't pass to another person at death, not an expansively defined non-probate estate.
- **Assessment vendors change**: DHCF moved Independent Assessment duties for long-term-services programs to Telligen on February 1, 2026, so applicants should confirm the current referral process rather than assume an older vendor name still applies.
- **Some figures are simply unresolved in public materials** — including a current District home-equity limit and a current transfer-penalty divisor — which makes direct confirmation with DHCF or qualified counsel a genuine planning step, not a formality.
