# Long-Term Care Funding in Colorado

Colorado runs its Medicaid long-term-care system on an income-cap model, but with a twist most income-cap states skip: instead of one statewide private-pay rate for transfer-penalty math and income-trust decisions, the state splits the calculation across four separate geographic regions. Where someone lives inside Colorado changes the numbers that apply to their case.

The state also has a beneficiary-deed law that catches families off guard. Rather than functioning as a quiet probate-avoidance shortcut, Colorado's statute makes clear that having a recorded beneficiary deed in effect turns the property into a countable resource and can disqualify the owner from the very Medicaid assistance they may need.

## Why Colorado is different

- **An income cap, not a spend-down state** — Colorado uses a 300%-of-SSI income limit ($2,982/month for 2026) rather than a medically needy spend-down pathway for its long-term-care Medicaid.
- **Four regional private-pay rates, not one** — 2026 nursing-facility private-pay rates range from $9,780.17 to $11,522.44 per month depending on the region, and those same regional figures drive income-trust and transfer-penalty calculations.
- **The beneficiary deed is a Medicaid risk, not a shortcut** — Colorado's statute and its required statutory form both warn that a recorded beneficiary deed makes the property a countable resource and can disqualify the owner from the described medical assistance.
- **Only one HCBS waiver has an active waitlist** — Colorado's Elderly, Blind, and Disabled Waiver currently has no waitlist; the Developmental Disabilities waiver is the one program HCPF identifies as having an active waitlist.
- **Five state veterans' living centers** — Colorado operates five Veterans Community Living Centers alongside a homestead exemption for qualifying disabled veterans.
