# Long-Term Care Funding in Arkansas

Arkansas runs its long-term-care Medicaid pathways on an income-cap basis. Someone whose countable income exceeds the state's limit can establish an irrevocable Miller Income Trust to become eligible, but there's a catch: whatever balance remains in that trust at death has to be paid to the Arkansas Department of Human Services (DHS).

On the property side, Arkansas offers a statutory beneficiary deed as a way to pass real estate at death outside of probate. DHS, though, describes its estate-recovery process as a claim against the estate broadly, and it's careful to note that the treatment of any individual beneficiary deed still needs its own document-specific review rather than a blanket assumption that it shields the asset.

## Why Arkansas is different

- **Income-cap structure**: Arkansas's 2026 monthly income limit is $2,982 across Nursing Facility, Assisted Living, ARChoices, and DDS Waiver categories, with applicants treated as individuals for income purposes even when married.
- **Miller Income Trust with a payback catch**: an irrevocable trust can absorb income above the cap, but Arkansas DHS requires a Medicaid-payback provision for whatever balance is left in the trust when the beneficiary dies.
- **Beneficiary deed available, but not a guaranteed shield**: Arkansas Code § 18-12-608 authorizes a deed that transfers real property only at death, but DHS's estate-recovery guide doesn't specifically resolve how every beneficiary deed is treated, so legal review matters.
- **Two distinct home-and-community-based routes**: ARChoices in Homecare and Living Choices assisted living both serve as alternatives to a nursing facility, each with its own financial and level-of-care requirements.
- **Annually re-set transfer penalty divisor**: DHS re-determines its transfer-penalty divisor every year effective April 1, referring readers to Appendix R — though a current 2026 figure wasn't available in the materials reviewed for this page.
