# Arizona Beneficiary Deed

Last updated 2026-10-20

Arizona gives homeowners a statutory real-estate transfer tool called a beneficiary deed. Under A.R.S. § 33-405, an owner can convey real property to a named grantee beneficiary as long as the deed states plainly that it becomes effective only at the owner's death. The statute allows multiple grantee beneficiaries and recognizes several forms of co-ownership — joint tenancy with right of survivorship, tenancy in common, community property, and community property with right of survivorship.

Because the transfer takes effect at death rather than at signing, the owner keeps full control during life and can revoke the deed at any point by recording either a revocation or a later beneficiary deed. Those features make the tool attractive for probate planning, but they don't answer Medicaid transfer, lien, or estate-recovery questions on their own.
