# Alabama Medicaid Estate Recovery

Last updated 2026-10-20

According to Alabama Medicaid's Estate Recovery Q&A, the program recoups costs it paid on behalf of deceased recipients in covered categories from those recipients' estates. The property subject to recovery is defined as real and personal property, plus other assets that fall under the individual's estate as defined by Alabama probate law — this can include a home, land, vehicles, cash, and bank accounts.

In other words, Alabama's published definition ties recovery to the probate estate rather than an expanded definition that names joint tenancy, life estates, or living trusts outright. A current Alabama elder-law source backs up this probate-only characterization. Still, that shouldn't be read as a blanket assurance — how a title or beneficiary arrangement is structured matters, and no single nonprobate device automatically defeats every lien, claim, or transfer rule that might apply. Survivor protections and an undue-hardship process exist for families affected by a recovery claim.
